The following forms must be distributed on an annual basis and can be included with the Open Enrollment documents.  However, it’s important to note that if your company’s open enrollment does not fall within the time frame allotted, we recommend you send separately.

Medicare Part D NoticeSummary of Annual Report

This notice informs Medicare Part D eligible participants whether the prescription drug coverage under the group’s plan is credible (equal or greater than coverage provided under Part D).  This allows these individuals to make an informed decision regarding enrollment into Part D, as those with non-credible coverage may be penalized for last enrollment into Medicare Part D.  Notice must be provided by October 15th each year.

The Summary of Annual Report is a summary of the Form 5500 filing that employers file with the DOL if they have over 100 participants or have a funded plan.  If applicable, notice should be distributed within 9 months after the end of the plan year or two months after the due date of the Form 5500.  Current 5500 filings are due on or before 7 months after the end of the plan year.
